The leadership of the Association of Nigerian Licensed Customs Agents (ANLCA) has alerted Justice Savage of the Ikeja High Court not to allow himself to be  misled into promoting the miscarriage of justice by acting on orchestrated lies fed him through an application filed by the sacked Chairman of Murtala Mohammed International Airport (MMIA) Chapter , Prince Bangbala Adewusi.

According to the association, the exparte motion granted to Adewusi to remain in office was obtained fraudulently in view of the fact that the application presented before Justice Savage reek of falsehood and not in tandem with reality, and that the judge acted upon such faulty and misleading application by granting Adewusi the exparte motion.

The order as it stands, indicate the failure of the judge to carry out due diligence before hurriedly granting a faulty ruling, the association claimed. The ANLCA national officer who does not want his name mentioned in print urged the Justice Savage to vacate the erroneous Court Order to preserve his professional integrity and name from being rubbished so cheaply by power mongers, who only seek their personal interests above the national good.

The members explained that the exparte order granted Adewusi which restrains the Board of Trustees (BoT) and National Executive Committee (NECOM) from ejecting him out of office is unqualified and incompetent based on the overall facts of the case.

He further explained that the exparte order is incompetent in view of a valid ruling by Justice Ogundare of the Badagry High Court that declared Tope Akindele as the rightful occupier of the office having also declared him winner of the chapter election conducted in 2019.

He notes that strangely, rather than the NECOM of that time to adhere to the ruling of the Badagry Court went ahead to conduct another kangaroo election in which the NECOM for own reason declared Adewusi winner and foisted him in the office, despite that his co-contestant, Balogun Ashiru obtained a court judgment declaring himself winner of the said election.

He urged Justice Savage to also take note of that fact that Adewusi who claimed to have vacated the Badagry High Court judgment has no locus to contemplate such since he was not a party to the case in any material circumstances.

He said running to Justice Savage to secure an exparte motion is an abuse of court process which the learned judge must distance himself from as an unbiased minister in the temple of justice.

He called on Justice …to either reverse his order or excuse himself from the case to avoid creating chaos in the association, and more than that, to shun actions that will expose the judicial system into public opprobrium.
