Court nullifies ANLCA Owerri AGM/BOT election
Order Police to Seal National Secretariat
The Federal High Court Kano Division has invalidated the Association of Nigeria Licensed Customs Agents (ANLCA) Annual General Meeting (AGM) together with The Board of Trustees (BoT) election conducted at the Concorde Hotel Owerri on December 16th, 2020, through an interim injunction.
The interim injunction was granted sequel to Suit No: FHC/KN/CS/79/2021, filed by ANLCA Registered Board of Trustees on 25th March 2021. The ruling also directed the Inspector General of Police to immediately seal the National Secretariat of the Association pending the hearing of Motion on Notice as filed by The Registered Trustees of Association of Nigeria Licensed Customs Agents, and ten others, including Alhaji Taiwo Mustapha, Chief Dennic Okafor, Chief Sir Ernest Elochukwu, Prince Taiye Oyeniyi and Mr. Dayo Azeez.
According to the certified true copy of the judgment, the defendants include the Corporate Affairs Commission, Sifax Group, Iju Tony Nwabunike, Mr. Kayode Farinto, Mukhaila Babatunde, Dr. Taiwo Afolabi, Igbamola Eniola John, Offor Kingsley and seventeen others.
Justice A. Lewis-Alagao of the Federal High Court Kano restrained the National Executive Committee (NECOM), Sifax Group, Dr. Taiwo Afolabi and other defendants/respondents from parading themselves as Trustees of the Association of Nigeria Licensed Customs Agents pending the hearing and final determination of the Motion on Notice.
The judgment reads in part:
“AN ORDER OF INTERIM INJUNCTION of the Honourable Court restraining the 7th to 24th Defendants/Respondents either by themselves, their servants, proxies, and agents or whosoever from acting, signing or writing letters or parading themselves as Trustees of the Association of Nigeria Licensed Customs Agents pending the hearing and final determination of the Motion of Notice.
“AN ORDER OF INTERIM INJUNCTION of the Honourable Court restraining the Defendants/Respondents either by themselves, their servants, proxies, and agents or whosoever howsoever from taking any action (s), step(s) or conducting themselves in any manner that is capable of harassing, intimidating, restraining or inhibiting the 2nd to 11th Plaintiffs and the other Trustees of the 1st Plaintiff registered with the 25th Defendants/Respondents as contained in the Certificate of Registration dated 16th January, 2020 from functioning as the Lawful Registered Trustees of the Association of Nigeria Licensed Customs Agents pending the hearing and final determination of the Motion of Notice.
“AN ORDER of the Honourable Court directing the Inspector General of Police through its officers, and all other police formation and commands and any other Law enforcement and Security agencies to secure and seal up the National Secretariat of the Association of Nigeria Licensed Customs Agents located at Dikko Inde House, Plot 347, Durbar Road, Amuwo-Odofin, Lagos pending the hearing and final determination of the Motion of Notice.
